Terms and Conditions
1. Products, Substitutions and Pricing
While we make every effort to supply you with your chosen products, sometimes stock and suppliers may change.Where Chrisco is unable to supply the original product or an agreed upon substitution, Chrisco may cancel the Agreement and provide you with a full refund of the payments you have already made. Our Cancellation Policy (section 3) will not apply.
2. Payments
Your order requires you to make regular weekly, fortnightly or monthly payments (chosen by you).- 2.1 How can I pay? By Direct Debit, Automatic Payment, or Credit Card.
- 2.2 What is a Direct Debit Request? A Direct Debit Request authorises a payment to be automatically deducted from your bank account. By filling out the Direct Debit Request form in this catalogue or on our website, or over the phone, you are authorising Chrisco to debit your payments from your chosen account. At 4pm on the day you have chosen (usually your pay day), our bank debits your account electronically.
- 2.3 Can I stop a Direct Debit payment? Yes, if you call us by midday the working day before your payment is due (before midday Friday for a Monday payment), we can stop a payment.
- 2.4 What happens if I can’t keep up my payments? Contact us to discuss your options. See also the Cancellation Policy (section 3).
- 2.5 Payments on Public Holidays? Payments will come out the working day prior to the public holiday. We observe all Auckland public holidays. If you wish to skip a payment, let us know by midday the working day prior.
- 2.6 Skipped or Missed Payments?
- (a) Missed payments will be spread over your future payments so your order is fully paid by the Final Payment Date. We will notify you of the recalculated payment amount.
- (b) We reserve the right to reduce your order in proportion to your missed payments or cancel your order if payments fall too far behind. Our Cancellation Policy (section 3) will apply.
- 2.7 Dishonoured payments? Your bank may charge a fee. Chrisco will charge a $2.50 administration fee to cover our costs.
3. Cancellation Policy
- 3.1 HeadStart Cancellation: HeadStart Plans can be cancelled at any time without a cancellation fee, unless converted into an order. Once converted, clauses 3.2 to 3.3 will apply.
- 3.2 Order Cancellation: You may cancel at any time prior to delivery. If cancelled within 21 days of your original order confirmation (Cooling Off Period), no cancellation fee applies.
- 3.3 After the Cooling Off Period: A cancellation fee of up to 20% of the amount paid may apply (up to $250). For Mastercard® orders, a $20 fee per card (maximum $120 per quarter) applies.
4. Refund Policy
- 4.1 HeadStart Payments: Fully refundable unless converted into an order. If not confirmed, refunds remain available even after delivery upon return of goods.
- 4.2 Refund Method: Refunds can only be applied back to the original account or card used:
- (a) Direct Debit → refunded to original bank account
- (b) Credit Card → refunded to original card
- (c) Automatic Payment → refunded by direct credit to your verified bank account
5. HeadStart Plan The HeadStart Plan allows you to make payments towards next year’s order, giving you time to decide which products to choose. Full details include:
- 5.1 Starting a Plan: Contact our Customer Service team, set it up online, or opt-in via order form.
- 5.2 Payments: Payments are based on either your previous order value or an agreed amount. Fully refundable unless converted into an order.
- 5.3 Converting: You can convert your HeadStart into an order via catalogue, email, or phone. Once converted, the Cancellation Policy applies.
- 5.4 Non-conversion: If not converted by 1 March, Chrisco may place an order on your behalf (similar to your last order or equal to your payments). You will be notified and asked to confirm.
- 5.5 Opting Out: You may opt out at any time. If an order was placed on your behalf, it will be refunded in full.
- 5.6 Free Gift: Customers who convert HeadStart into a fully paid order receive one free gift per year.
6. Contacting You
- 6.1 Contact Details: Keep your contact information updated. Failure to do so may result in us deducting up to $40 per annum in costs to locate you.
- 6.2 Inactive Accounts: Credit balances under $40 and older than 6 months may not be refunded unless you contact us.
- 6.3 Promotional Consent: You may opt out of promotional communications at any time. Non-promotional communications regarding active orders will continue.
7. Delivery, Processing, Packing and Administration
- 7.1 Signature Required Delivery Fee: $12.50 surcharge per hamper.
- 7.2 Heavy Items: $57.50 surcharge per hamper.
- 7.3 Super Heavy Items: $287.50 surcharge per hamper.
- 7.4 Gift Card Fees:
- Processing Fee: $5.75 per card
- Delivery Fee: $12.50 per address
- Signature Required delivery
- Delivery no later than the first week of December
- Gift Cards are not redeemable for cash, cannot be replaced if lost, and carry their own retailer terms.
- 7.5 Delivery: Made from November to mid-December. Multiple items may arrive separately. Redelivery fees may apply if you’re not home.
- 7.6 Onforwarding Charges: Some rural/island areas may incur additional charges. See Delivery Terms.
- 7.7 Change of Address: Notify Chrisco immediately. Fees may apply if changed after Final Payment Date.
- 7.8 Depot Collections: If you fail to collect your order, perishable food may be donated after 3 days and non-perishables considered abandoned after 20 days.
- 7.9 Rural Delivery: Some rural areas may require collection from a local depot.
- 7.10 Disclaimer: Chrisco is not liable for delays beyond its control.
8. Returns Due to the perishable nature of goods, returns are not accepted except as required by law. Damaged items will be replaced or refunded. Refunds also apply for goods ordered on your behalf under clauses 4.1, 5.6, and 5.7.
9. Warranties and Liabilities You have statutory rights under the Fair Trading Act 1986 and Consumer Guarantees Act 1993 which cannot be excluded. Subject to these rights, all other warranties are excluded to the fullest extent permitted by law.
10. Safety and Council Regulations
10.1 Motorised Products:- Should be assembled by a professional. Helmets must always be worn. Use is off-road only.
- 10.2 Outdoor Equipment, Pools and Spas: Check local council safety and water use regulations.
11. Catalogue
11.1 Errors & Omissions:- Product images are illustrative. Chrisco is not responsible for errors in typography or photography.
